Executing Effective Investigations in Tribal Communities

Internal and external investigations are becoming increasingly necessary in Indian Country. This panel will share best practices for structuring, launching, and executing an investigation, as well as coordinating with criminal or regulatory enforcement agencies. To do so, this panel will unpack Navajo Nation v. Dineh Benally, a civil action that culminated from the investigation and discovery of a massive illegal marijuana operation on Tribal lands, employing more than 1,000 low-income Chinese immigrant workers. This panel will also consider important topics that often arise in both internal and external investigations, such as privilege, retaliation, liability, and conflicts of interest.
