This panel will provide a broad overview of the Indian Self-Determination Act (ISDA) and implementation of the statute by both the Indian Health Service (IHS) and Bureau of Indian Affairs (BIA), examining current agency challenges, the continued fight for resources for tribally-contracted programs, and what’s next for self-governance expansion. We will then explore how this decades-long fight for resources has played out in recent litigation over Secretarial amount funding, the 105(l) lease program, and contract support costs. The panel will also delve deeper into the 105(l) lease program, discussing how tribes have leveraged it to obtain additional federal funding to maintain their existing buildings and construct new tribal facilities across Indian Country. Overall, the panel will offer considerations for in-house counsel advising their tribes on whether to contract and how to take advantage of some of these more recent funding opportunities if they are already contracting.
